Terms of use
Last updated 24 October 2026
These terms are the agreement between your business and us when you use RingSmith. Please read them: by creating an account you accept them.
1. Who we are
RingSmith is provided by HoyCall Ltd, a company registered in England and Wales with company number [company number], whose registered office is at [registered office address]. VAT number [VAT number, if registered]. “We” and “us” mean HoyCall Ltd; “you” means the business using RingSmith and the person who sets it up for that business.
You can reach us at support@ringsmith.app.
2. Your account
- RingSmith is for businesses, sole traders included. You must be at least 18 and allowed to act for the business.
- The details you give us, including your mobile number and business details, must be true and kept up to date.
- Keep your sign-in safe. You’re responsible for what happens in your account.
Because you use RingSmith for your business, consumer protection law that applies only to consumers doesn’t apply to these terms.
3. What RingSmith does
RingSmith answers calls to your business with an automated voice assistant. It speaks to callers, takes their details, can book appointments in your calendar and send callers messages, and tells you about each call.
- It can make mistakes. It uses artificial intelligence and may mishear a caller, misunderstand them, or record details or bookings wrongly. Check summaries and bookings before you rely on them, and call back when it matters.
- It doesn’t transfer calls to you. It takes a message and alerts you; it can’t put the caller through.
- It isn’t an emergency service. Don’t rely on it where a missed or delayed reply could put someone at risk. It tells callers with an emergency to contact the emergency services.
- It depends on other networks. Calls rely on your mobile network, our telephone provider and the internet. We work to keep RingSmith running, but can’t promise every call will be answered.
We keep improving RingSmith and may change its features. If a change takes away something important to you, we’ll tell you in advance where we can, and you can cancel.
4. Subscriptions and payment
- You subscribe in the app through the Apple App Store or Google Play. Their terms cover payment, renewal, free trials and refunds, and you manage or cancel your subscription with them.
- Subscriptions renew automatically until you cancel. Cancelling stops the next renewal; you keep RingSmith until the end of the period you’ve paid for.
- Prices and what each plan includes, such as the number of call minutes, are shown in the app before you subscribe. If a plan’s minutes run out, RingSmith keeps answering with shorter calls that take a message.
- If we change the price of your plan, we’ll tell you before it applies, and Apple or Google will ask for your agreement where their rules require it.
5. Diverting your phone
If you divert your mobile to RingSmith, you set that up on your own phone with your network.
- Your network may charge you for diverted calls. Those charges are between you and your network.
- While the divert is on, RingSmith replaces your voicemail.
- Not every network or plan supports diverts. The app tells you what we know; on a network we haven’t tested, it may not work.
- Turn the divert off when you stop using RingSmith. Dialling ##002# removes every divert on most networks.
6. Your RingSmith number
We give you a phone number to receive your calls. It stays ours: you can use it while you have an account, but you can’t transfer it to another provider. When you leave, it answers with a message saying your business no longer uses it, and after a while we release it. We won’t pass it straight to another RingSmith business.
7. Your callers
When RingSmith answers for you, it speaks on your behalf. You’re responsible for:
- what you set it up to say, including prices, opening hours and the greeting;
- telling people how you handle their data, for example in your own privacy notice;
- following the law if you turn on call recording. RingSmith tells callers that calls are recorded; you must have a lawful reason to record them;
- bookings it makes for you, and honouring or cancelling them.
8. Processing callers’ data for you
For callers’ personal data, you are the controller and we are your processor under the UK GDPR (and the EU GDPR where it applies). This section is our data processing agreement with you.
- What and why: we process callers’ phone numbers, what they say, the details they give, transcripts, summaries, bookings and, if you turn it on, recordings, to answer and handle calls for you for as long as you use RingSmith.
- Your instructions: we process it only to provide RingSmith as these terms and your settings describe, unless the law requires otherwise, in which case we’ll tell you unless the law forbids it.
- Confidentiality and security: people who can access it are bound to keep it confidential, and we protect it with appropriate technical and organisational measures.
- Sub-processors: you allow us to use the companies listed in our privacy policy. We’ll update that list before adding a new one, and you can object by contacting us; if we can’t resolve it, you can cancel. We hold each to data protection terms at least as protective as these.
- Transfers outside the UK and EEA are protected as our privacy policy describes.
- Helping you: we’ll help you answer callers who use their data protection rights, tell you without undue delay after we become aware of a personal data breach affecting your callers, and help with any assessment or consultation you need to carry out.
- At the end: when you delete calls or your account, we delete the data, except where the law requires us to keep it.
- Checks: we’ll give you the information you reasonably need to show we keep to this section.
9. Using RingSmith properly
Don’t use RingSmith to:
- break the law, or mislead or harass anyone;
- pretend to be another business or person;
- answer calls for a business you don’t own or aren’t allowed to act for;
- make unwanted marketing calls or messages;
- copy, take apart or interfere with the app or our systems, or get around its limits.
The app, the RingSmith name and our content belong to us or the companies we license them from. We give you a personal, non-transferable right to use the app for your business while you have an account. Your business details and your calls stay yours.
10. Ending
- You can stop at any time: cancel your subscription with Apple or Google and delete your account in the app.
- We may suspend or close your account if you seriously or repeatedly break these terms, if your subscription isn’t paid, or if we have to by law. Unless it’s urgent or unlawful, we’ll warn you first.
- We may stop offering RingSmith. If we do, we’ll give you at least 30 days’ notice and refund any part of a payment for time you can’t use, as far as the app stores allow.
11. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
- We aren’t liable for lost profits, lost business, lost bookings or customers, or indirect losses, including from a call that wasn’t answered or a booking that was wrong.
- Otherwise, our total liability to you in any 12 months is limited to what you paid for RingSmith in those 12 months.
12. Apple and Google
These terms are between you and us, not Apple or Google, and we, not they, are responsible for RingSmith and for supporting it. If you downloaded RingSmith from the App Store, Apple’s standard licence terms also apply, and Apple may enforce these terms as a third-party beneficiary. Apple has no obligation to provide maintenance or support for RingSmith. Where the app doesn’t meet a warranty that applies, you may tell Apple, and Apple will refund the price you paid for it, if any; Apple has no other warranty obligation. Apple isn’t responsible for any claims about RingSmith, including product liability claims, claims that it doesn’t meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone else’s intellectual property; we are.
13. General
- We may update these terms. If a change matters, we’ll tell you in the app or by email at least 30 days before it applies. If you don’t agree, you can stop using RingSmith before then.
- If part of these terms can’t be enforced, the rest still applies.
- You can’t transfer these terms to someone else without our agreement. We may transfer them to a company that takes over RingSmith.
- These terms are governed by the law of England and Wales, and its courts decide any dispute.
